Ten Tech Solutions is operated by Ten Tech Solutions Pvt Ltd, Mahalaxmi Municipality, Lamatar, Lalitpur, Nepal.
In these policies, "Ten Tech", "we", "us" and "our" mean Ten Tech Solutions Pvt Ltd.
2. Your account
- You must give accurate, complete and current information and keep it up to date, especially your email address and contact details.
- You are responsible for keeping your password safe and for everything done through your account. Tell us straight away if you think someone else has access.
- You must be at least 18 years old, or the age of majority where you live, and able to enter into a contract. If you act for a business, you confirm you are authorised to bind it.
3. Orders, prices and payment
- Online prices are shown in Nepalese rupees (NPR). Value added tax (VAT, currently 13%) is added at checkout and shown before you pay.
- Prices for domains and hosting follow our providers' costs and the exchange rate, so they can change at any time. The price you see at checkout is the price you pay for that order.
- Online payment is made through Khalti. An order is accepted only when Khalti confirms the full payment. Payment in someone else's name, or that cannot be verified, may be refused.
- Website development and marketing services are provided under a written proposal or invoice. That document sets out the scope, price, currency, payment schedule and any taxes, and it takes priority over these terms if they conflict.
4. Automatic set-up
After payment, most domains, hosting and email accounts are set up automatically through our provider. If something cannot be completed automatically, for example because a domain was taken in the meantime or a registry needs more information, we will contact you. We will then complete the order by hand, offer an alternative, or refund you under our Refund Policy.
5. Domain names
- Domain registration is first come, first served. A domain shown as available may be registered by someone else before your payment completes.
- Every domain is registered under the rules of its registry and of ICANN, and you agree to follow them. This includes the domain name dispute rules (UDRP) and any eligibility requirements, such as the US nexus requirement for .us domains.
- You must provide accurate registrant details and respond to verification emails from the registry or registrar. A domain can be suspended if its details are not verified.
- You are responsible for making sure the name you choose does not infringe anyone else's trademark or rights.
- Renewals are not automatic. We send reminders before expiry, but it is your responsibility to renew on time. Expired domains may be deleted, and restoring them can cost much more or be impossible.
- You may transfer your domain to another provider, subject to registry rules. For example, transfers are not allowed within 60 days of registration or certain changes.
6. Hosting and business email
- Each plan includes the resources shown when you buy it, such as disk space, bandwidth and number of email accounts. Fair use applies to features described as "unlimited".
- A hosting or email plan is linked to one domain name. Our provider allows only one plan of each type per domain across all its customers.
- You are responsible for your website content and for keeping your own backups. Our provider may keep backups, but they are not guaranteed for restoring your data.
- We may suspend a service that harms the server, other customers or our network, or that breaks the acceptable use rules below. Where possible, we will warn you first.
7. Acceptable use
You must not use our services to:
- send spam or unsolicited bulk email
- host or spread malware
- run phishing or fraud
- infringe copyright or trademarks
- publish illegal content or content that sexually exploits children
- attack other systems
- mine cryptocurrency on shared hosting
- launder money or evade sanctions
We may suspend or end services immediately for serious breaches, and we report illegal activity to the authorities.
8. Websites and digital marketing
- Ownership: once paid in full, you own the website content and designs created specifically for you. Third-party themes, plugins, fonts, stock images and software remain under their own licences.
- Your materials: you are responsible for the accuracy of the content you give us, and for having the right to use it.
- Advertising: advertising budgets are paid to the platforms (for example Meta or Google), and their policies apply. We do not guarantee specific results such as rankings, leads or sales, because these depend on factors outside our control.
9. Third-party providers
Domains, hosting, email, payments and advertising rely on third parties such as registries, our wholesale provider, Khalti, Meta and Google. Their downtime or decisions are outside our control. We will help you deal with them where we can.
10. Liability
- Our responsibility: we provide our services with reasonable skill and care.
- The limit: to the extent the law allows, we are not liable for indirect or consequential losses, such as lost profit, lost data or lost business. Our total liability for any claim is limited to the amount you paid us for the service concerned in the 12 months before the claim.
- What is not limited: nothing in these terms limits liability that cannot be limited by law.
11. Ending services
- Cancelling: you may stop using a service at any time; refunds follow our Refund Policy.
- Our right to end services: we may end services if you seriously or repeatedly break these terms, if payment is reversed, or if the law requires it.
12. Changes to these terms
We may update these terms from time to time. The version in force when you place an order applies to that order. We will tell account holders about important changes.
13. Governing law
These terms are governed by the laws of Nepal. The courts of Nepal have jurisdiction, unless the law where you live gives you other rights.
